INSURANCE ACT 2015

This Act came into effect in the latter part of
2016 and has made significant changes when renewing or making
changes to our Church Insurances. The Act replaces much older
legislation dating back to 1906 and is designed to modernise insurance
law and put the insured party in a more favourable position by providing
greater protection against insurers avoiding claims.
However, as part of this change when changing or renewing an insurance
policy, it introduces a new duty of “fair presentation” that modifies
the previous duty of disclosure. It requires us to make a fair presentation
of every material circumstance that we know or ought to know that might
influence the insurer in assessing the risk and the terms and conditions
that it would apply.
Whilst confident that through the ongoing diligence of the Fabric &
Health & Safety Committees, coupled with input from members of the
Kirk Session, we are complying with this legislation, nonetheless,
should any member of the Congregation have or become aware of any
Health & Safety, Fabric or Insurance issues, please speak to or
phone David Blair, Fabric Convenor, Scott White, Health & Safety
Convenor or myself, Jim Fyfe.
ON DUTY TODAY: Pauline Davidson, Patsy Durning, Moira Gray,
Jim Inglis, Margaret Killin, Audrey Stewart.
ON DUTY NEXT WEEK: Linda Gemmell, Eileen Longmuir,
David Marsh, Maureen Marshall, Graham Mitchell, Audrey Stewart.
Reader: Joan Reynolds.
